Can-Caddy Terms & Conditions of Service:
This agreement (the "Agreement") is between you ("Customer") and Can-Caddy LLC ("Can-Caddy," "we," or "us"). By using Can-Caddy’s services, you agree to be bound by this Agreement. If you do not accept these terms, you may not use Can-Caddy’s services.

Definitions:
• Can-Caddy: Refers to Can-Caddy LLC’s can management service, including any software or apps provided.
• Helpers: Individuals employed or contracted by Can-Caddy to perform the service.
• Property Access: The Customer’s authorization for Can-Caddy or its Helpers to access the designated property to perform the service.
• Service Day: The scheduled day(s) for trash and recycling can management.

Services:
• Can-Caddy will take out and return 1 waste can and 1 recycling can per week on the designated Service Day, totaling up to 8 visits per month.
• After trash or recycling is collected, cans will be returned to the original storage location.

Home Access:
• By subscribing to Can-Caddy’s services, you authorize Can-Caddy and its Helpers to access your designated property for the purpose of managing your waste and recycling cans.
• You confirm that you have the authority to grant such access and that your property is safe for access by our Helpers.
• Customers must ensure unrestricted access to waste and recycling cans on Service Days, including providing gate codes, lock combinations, or moving pets from storage areas. If access is restricted, services will not be performed, and no refunds or credits will be issued.

Pricing and Payment:
• Recurring Fees: The monthly service fee is $60.00 plus applicable sales taxes. Additional cans are $5.00 per can per month, and driveways over 80 feet are subject to an additional $5.00 per month fee.
• Payment Method: Payments will be processed through Stripe. Customers authorize Can-Caddy to charge their payment method for recurring fees as per their selected payment plan.
• Price Changes: Can-Caddy reserves the right to adjust service fees with at least 2 months’ notice. Continued use of the service constitutes acceptance of the new pricing.
• Billing Cycle: Service is billed at the beginning of each month. Payments are non-refundable, and no partial credits will be issued for unused service.

Termination of Service:
• Can-Caddy reserves the right to terminate services at any time and at its sole discretion. In such cases, any prepaid service for future months will be refunded on a prorated basis.
• Customers may cancel service by providing at least 1 month’s notice via email.

Property Liability:
• Customers are responsible for maintaining safe access to their property. This includes code-compliance for gates, fencing, and other safety requirements.
• Can-Caddy is not liable for incidental property damage caused during reasonable use of the property to perform services.
• Can-Caddy is not responsible for damages to waste or recycling cans caused by acts of nature, vandalism, or misuse.

Dispute Resolution:
• Any dispute or claim arising from or relating to this Agreement will be resolved through binding arbitration in accordance with Massachusetts state law. Class action lawsuits are expressly waived.

Force Majeure:
• Can-Caddy shall not be held liable for service interruptions or non-performance due to events beyond its reasonable control, including but not limited to severe weather, natural disasters, or government actions.

Changes to Terms:
• Can-Caddy may amend this Agreement at any time by posting the revised terms on its website. Continued use of the service constitutes acceptance of the updated terms.

Recurring Payments Terms:
• Customers authorize Can-Caddy to charge their payment method for recurring payments at the start of each billing cycle. Payments are processed via Stripe.
• If a payment method is declined, Can-Caddy will attempt to process the payment for up to 20 consecutive days. Failure to resolve payment issues may result in service suspension.
• Customers are responsible for keeping payment information current.
